Michael Ellenbogen wrote:This is an excellent point. In our state if a family member is living in the home as a caregiver for at least two years prior to the individual going into a care facility, and it is their primary residence, the property is exempted from being considered an asset that needs to be used to pay for care prior to Medicaid payment. And the state will not seize the home after the person dies as they would normally as reimbursement for Medicaid coverage, leaving the home to the caregiver who was living there. I'm sure this is the case in many states, but again every state is different. Tina can probably find more information about this on her state's health & human services web site. This is one more reason why she should remain on the property.
One thing I did not see mentioned is the possibility of the land may end up with the state if your mother should ever end up under government assistance in a home. It could become very expensive to take care of her.

Thank you to everyone. I have some great news, I called the civil division of my local sheriff's office yesterday and they told me that he could try to file an eviction against me but the land is still in my Mom's name and I am her POA so it wouldn't stick, they sd as a matter of fact, I can evict him0

You still must find out if it is a POA or DPOA. You also need to know what the document requires of you.0
