When LO Refuses Care Options

Hello!  Our LO unfortunately says "no" when we suggest homecare services, adult daycare or MC.  An attorney said our LO has the right to say "no", even with a diagnosis of moderate ALZ and LBD.  We have no POA for our LO.  The same attorney said our LO wouldn't be competent to understand and sign POA documents due to LBD.  We wonder what our next step would be since we want to provide additional care for our LO in the near future.  We welcome your thoughts!

    We just went through this with my mom. It sounds like you should talk to another attorney. Ours indicated if my mom was no longer able to understand/sign documents we could go to court and have her legally declared incapacitated. It hasn’t come to that yet, we all sat down with her (attorney too) and told her the POA and moving to the facility were temporary until she was stronger and both but could be revoked/changed at any time. She was much more amiable to it under that premise. We still bring documents in for her to review and she doesn’t understand much, but it helps her to feel like she’s still in control.
