Does anyone understand the Health Care documents in NJ?
I am having trouble wrapping my head around what I need for mom as far as health care proxies. I have tried talking to a Elder Care Attorney, two in fact. One blew me off completely, and other wanted me to sign an $8,000 contract before further discussion. So I have become somewhat disenchanted with that route.
Most of the advice here and on other sites suggests one needs a Health Care POA, and that document needs to be "activated" by a doctor. New Jersey does not seem to recognize a Health Care POA. They do have something called an Advanced Directive, when I asked her doctor about getting it activated she looked at me like I had two heads. She gave me a different form called a POLST. I'm not sure either of these are what I need to get mom into Assisted Living and/or to prevent her from just calling a cab and leaving.

Here is a link to a form for a New Jersey POA which they call an "Advance Directive." In order to be valid, your mother must be able to sign it and it must have two witnesses over the age of 18 and the POA designee may not be a witness, and it must also be notarized. NOTE: I am NOT an attorney, this is only what I found online and it may be outdated or not accurate - best to have it verified by a legal person - Is there an AARP office near you? Also, the local Area Agency on Aging may possibly be helpful. They can often answer questions and there is also the Legal Aid Foundation if a person cannot afford an attorney. As it is, there are many attorneys; keep making ll you may find one that is suitably affordable.

The POLST is detailed and specific for end of life wishes; it does not establish a POA. This must be very frustrating trying to get it all together. Also, is there a nearby Alz Assn. office? Perhaps they could assist if they are in N.J.
So hope you are able get better advice or find a legal consultant soon.
