POA

Hello, I just joined and this is my first post. It's a question that I need answered soon. My husband has had dementia for almost 10 years now. Two years ago I knew I needed to get a POA so we updated our will. Last year he was barely able to sign our tax return. This year he definitely won't be able to but I'm not sure how to sign it. I did ask the layer when we did this and she said it's better if he can do it. Yes, of course it is…. so I didn't get an answer. I know I can legally sign his name , but I'm not sure if I write his name and add POA or how else to do. Any help would be greatly appreciated. Thank you.

    Page 18 talks about using non-IRS POA documents. I think you can use the POA you have, you just might have an extra step to do.

    I signed my LOs named then added "by (my name) POA" .

    When I sold my parents' home in FL I was acting on both their behalf. The notary had me sign Mom's First-Middle-Last by Harshed-Middle-Buzzed, Power of Attorney and then the same for dad. Nineteen characters for mom, seventeen for dad and twenty-three for my own name and there were so many forms. They collected my original POAs and returned them to me.

    Please check to see if it is a Durable Power of Attorney. If not, it is likely not vaid due to your husband's current condition.
