Hello,

My Mom is refusing to sign POA documents. At this time, she has not paid her taxes for a few years and almost lost her house in another state. How do I proceed to petition a court for conservatorship? Do I need a lawyer? Thanks. I am an only child and my Mom has always been a Rock for all family members and friends- we are all at a loss right now.

    I would get an attorney. A CELA if possible. You need to act quickly and prevail— a lawyer can help you make that happen.

    Both my aunt and a friend had to go the guardianship route; the former because the PWD had not been diagnosed and had serious assets and the latter because the PWD was actively refusing to cooperate with help. In both cases, cognitive assessments were done, the potential guardian was vetted (and family given a chance to object) and emergency guardianship was awarded fairly quickly. My friend even prevailed against his dad who hired his own lawyer to fight him.

    It's expensive, but in both cases the guardian was able to legally recover what they spent from their LO's assets.

    Agree. A CELA is a certified elder law attorney and you can find lists by location at nelf.org. they can also advise on how to get her qualified for Medicaid if needed for long-term care. The taxes will impact that.
