My brother had his neuropsych testing done today

We won't get the results until the 19th. It didn't take nearly as long as my hubby's testing did in 2013. I don't have any idea what the doctor thinks. I'll find out later. I did tell her that I want to know if he is still safe living alone and driving. He's driven me around a good bit the last two days. I never felt fearful as his passenger. I haven't seen any signs that his judgment is impaired or anything. He just has a terrible short-term memory. I did figure out something that works to my advantage. I can say things to him that really annoy him, but that's okay because he won't remember any of it later. So, I told the doctor exactly what I thought.

Another issue is that he is working on getting powers of attorney for healthcare and for finances. He and his now ex-wife set up a living trust in 2006. He copied the POAs from that document and changed the names of the agents that he wants to name to make decisions for him. My problem with his documents is that they don't have any effective dates listed. The ones that I had for my hubby had two options: effective immediately or effective when the principal becomes incapacitated. I'm not a lawyer or anything, but I think that the currently named agent, his ex-wife, can invoke them NOW. That troubles me. I talked to him about it and he was getting annoyed with me, but I don't care. He said he wants to ask a lawyer that he met at church what he thinks. Whatever. I just hope he gets it done soon.

I actually just completed my own financial POA. I found out that my old college roommate died in June, so I thought that I had better take care of it. I skipped seeing a lawyer and copied the form that my hubby signed and changed all the names. Nobody ever questioned it, so I'm sure it will still work. It's a springing and durable POA. I named my second son as my primary agent. He's the CPA in the family.

    Be worth a few hours of attorney time to have all the DIY stuff reviewed. Laws change, tax law changes etc.

    Seems odd their assets would still be in a marital living trust. Cheaper to get a legal review now then a court date later.
