DH has been in NH for 2 months. He has been wandering into other people's rooms. Last night got a call that he had pinched a woman and caused bruising. Needless to say the female resident was yelling and extremly upset. I feel terrible he did that to her and today he's having a psych evaluation in house. Anyone ever go through this? I assume the resident can press charges. I am beside myself. What happens now??

He's not going to jail. No court is going to find he has the mental capacity to be held responsible. What happens now is the psychiatrist is going to determine what he needs to keep him and the people around him safe.

No part of this is any fun, is it? Sorry, Maggie.

The resident's family may raise a stink with the NH, but your DH won't be held responsible. The NH may increase his meds so that he'll be sedated so much that he'll be sleeping most of the time to curb his behavior. Sadly, in these cases only finding the right medication will work.

My DH hit several other residents, and he is now in the Geri-Psych unit of a local hospital for medication management. At no time was there any talk of pressing charges. It is a memory care unit, after all, and at any time any one of the residents may act out. The hospital believes part of my DH's aggression was stemming from him not sleeping much, and just being irritable from that. He has been there a week now, and will probably stay until early next week as they are also increasing his Zoloft and want to monitor him. Don't worry about legal action - as others have said, there is no way you DH will be held responsible. Hopefully, a medication change will be enough to get him settled down. Good luck!
